Delhi Development Authority v. Dinesh Kumar Himatsingka and Ors.
Background
DDA had acquired the land in question years earlier without ever taking physical possession, and no stay was in operation to explain the delay. The landowner's side obtained a ruling below that the acquisition had lapsed under the 2013 land acquisition law, which DDA appealed to the Supreme Court.
Decision Breakdown
The Court held the issue was already covered against DDA by its earlier judgment in Civil Appeal No.8477 of 2016 (arising out of SLP(C) No.8467 of 2015) and dismissed the appeal. It granted DDA one year from the date of the order to initiate fresh acquisition by issuing a new Section 11 notification, failing which DDA, if in possession, would have to return physical possession to the original landowner.
Lesson Learnt
This case follows the now-settled rule that a government authority which neither pays compensation nor takes possession of acquired land within the statutory window risks having the acquisition lapse under Section 24(2) of the 2013 Act.
