Delhi Development Authority v. Gyanwati
Background
This is another in the same series of DDA land acquisition appeals heard together on 31 August 2016. DDA had acquired the land of Gyanwati and others without taking possession or completing compensation in time, and a finding below held the acquisition had lapsed under Section 24(2) of the 2013 Act. DDA appealed against that finding.
Decision Breakdown
Treating the point as settled against DDA by the lead ruling in Civil Appeal No. 8477 of 2016, the Supreme Court dismissed the appeal. It granted DDA a one-year period to issue a fresh Section 11 notification and restart acquisition, with the land to be returned to the original owner if DDA (while in possession) failed to do so within that year.
Lesson Learnt
The 2013 land acquisition law builds in real consequences, including lapse of the acquisition, for authorities who sit on acquired land without completing possession and compensation, protecting landowners from indefinite limbo.
