Delhi Development Authority v. Jagbir Singh and Ors.
Background
This is one of several near-identical appeals filed by the Delhi Development Authority (DDA) against findings that its land acquisition proceedings had lapsed as against landowner Jagbir Singh and others. The legal issue raised was identical in principle to one already decided against the DDA in Civil Appeal No. 8477 of 2016 (arising out of SLP (Civil) No. 8467 of 2015).
Decision Breakdown
Applying its own prior ruling on the identical point of law, the Court dismissed the DDA's appeal. It nonetheless gave the DDA a one-year window to invoke its liberty under Section 24(2) of the 2013 Act to initiate fresh acquisition proceedings via a new Section 11 notification, failing which, if the DDA was in possession, it was directed to hand back physical possession of the land to the original owner.
Lesson Learnt
The Supreme Court applies settled precedent consistently across multiple similarly-situated appeals from the same authority; a lapsed land acquisition does not automatically mean the landowner keeps the land forever: the acquiring body may still be given a limited window to restart the process properly.
