Delhi Development Authority v. Jai Prakash Tyagi and Ors.
Background
Yet another appeal in the same series by the Delhi Development Authority (DDA), this time against landowner Jai Prakash Tyagi and others, raising the identical legal issue already decided against the DDA in Civil Appeal No. 8477 of 2016 (arising out of SLP (Civil) No. 8467 of 2015) regarding lapse of acquisition under the 2013 Act.
Decision Breakdown
The Court dismissed the appeal on the strength of its own earlier ruling on the same point of law. It granted the DDA a one-year period to initiate fresh acquisition proceedings under Section 24(2) of the Act via a new Section 11 notification, failing which the DDA, if in possession, was directed to return physical possession of the land to the original owner.
Lesson Learnt
Consistent application of precedent means landowners facing near-identical delays by the same acquiring authority can expect the same relief across multiple cases; however, a lapse finding is not an absolute bar: authorities get one more defined chance to act.
