Delhi Development Authority v. Khushi Khan and Ors.
Background
This is one of several near-identical appeals filed by the Delhi Development Authority against landowners after an earlier land acquisition lapsed. The underlying legal question was already settled against DDA in Civil Appeal No. 8477 of 2016 (arising from SLP (C) No. 8467 of 2015).
Decision Breakdown
Following the precedent set in Civil Appeal No. 8477 of 2016, the Court dismissed DDA's appeal. It granted DDA a one-year window from the date of judgment to issue a fresh notification under Section 11 and restart acquisition under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. If no fresh notification issued within that year, DDA (if in possession) was directed to return physical possession of the land to the original owner.
Lesson Learnt
Government authorities whose land acquisition has lapsed under the 2013 Act must act within a court-imposed time limit to restart the process, or the land must revert to the original owner: delay has real consequences.
