Delhi Development Authority v. Khushi Mohd. & Anr.
Background
DDA had acquired land affecting the respondent, Khushi Mohd., and the dispute over the validity/continuation of that acquisition reached the Supreme Court on DDA's appeal. As with several other DDA matters decided the same day, the underlying legal question was whether the authority could still rely on an old acquisition notification.
Decision Breakdown
The Court found the issue, in principle, covered against DDA by its judgment in Civil Appeal No. 8477 of 2016 (arising out of SLP(C) No. 8467 of 2015). Accordingly, the appeal was dismissed. In the peculiar facts of this case, DDA was given one year to exercise its liberty under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, to initiate fresh acquisition by issuing a notification under Section 11 of that Act.
Lesson Learnt
Even where an authority loses on the core legal issue, courts can balance equities by giving it a fixed, final window to restart the process properly, but if that window lapses without action, and the authority holds possession, the land must go back to its original owner.
