Delhi Development Authority v. Mahavir Prasad Gupta and Others
Background
DDA appealed against a finding that its acquisition of the respondent's land had lapsed under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for failure to take possession or pay compensation within the prescribed period.
Decision Breakdown
Following the Court's own lead judgment in Civil Appeal No. 8477 of 2016, the issue was held to be covered in principle against DDA, and the appeal was dismissed. The Court nevertheless gave DDA a one-year window from the date of the order to initiate fresh acquisition proceedings by issuing a fresh notification under Section 11 of the 2013 Act, failing which DDA (if in possession) was directed to hand back physical possession of the land to the original owner.
Lesson Learnt
This is part of a recurring pattern of DDA land-acquisition cases decided the same day on identical reasoning: landowners whose land was acquired long ago but never actually taken over or compensated can get the acquisition declared lapsed, though the authority may still get one more chance to acquire it properly.
