Delhi Development Authority v. Manjeet Singh
Background
This appeal arose from the same recurring dispute as a batch of other DDA appeals decided the same day: DDA had acquired land but had neither taken possession nor completed the compensation process, and the landowner (Manjeet Singh) had won a finding below that the acquisition lapsed under Section 24(2) of the 2013 land acquisition law. DDA challenged that outcome in the Supreme Court.
Decision Breakdown
The Court held the issue was already covered against DDA by its lead decision in Civil Appeal No. 8477 of 2016, and on that basis dismissed this appeal as well. As in the related cases, the Court softened the blow slightly by giving DDA one year to begin fresh acquisition proceedings through a new Section 11 notification, with a direction that if DDA failed to do so within that year and was in possession, it had to return the land to the original owner.
Lesson Learnt
Government authorities cannot indefinitely delay taking possession or paying compensation after acquiring land; the law gives landowners a real remedy, lapse of the acquisition, when statutory timelines are ignored, even though courts may grant a short grace period for a fresh start.
