Delhi Development Authority v. Mohd. Yahya
Background
DDA had acquired land belonging to Mohd. Yahya and others but had not taken possession or completed compensation within the time required, resulting in a finding below that the acquisition had lapsed under Section 24(2) of the 2013 Act. DDA challenged that finding before the Supreme Court.
Decision Breakdown
The Supreme Court treated the issue as already decided against DDA in its lead ruling, Civil Appeal No. 8477 of 2016, and dismissed the appeal. It allowed DDA one year to begin a fresh acquisition by issuing a new Section 11 notification, with the direction that if that deadline passed without a fresh notification, DDA (if in possession) must return the land to the original owner.
Lesson Learnt
Even a public authority like DDA cannot indefinitely hold acquired land without completing possession and compensation; the 2013 Act's lapse provision gives citizens a concrete remedy against such administrative delay.
