Delhi Development Authority v. M/s. Band Box Pvt. Ltd. and Ors.
Background
The Delhi Development Authority (DDA) appealed against a decision favouring the original landowner, Band Box Pvt. Ltd., concerning land whose acquisition under the earlier law had been found to have lapsed. The matter came to the Supreme Court via a Special Leave Petition converted into this appeal.
Decision Breakdown
The Court held that the point of principle was already settled against DDA in its own earlier judgment in Civil Appeal No. 8477 of 2016, and dismissed the appeal on that footing. It granted DDA one year to exercise its liberty under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 by issuing a fresh notification under Section 11 to restart acquisition. Failing that within the year, DDA, if in possession, would have to return physical possession of the land to the original owner.
Lesson Learnt
A lapsed land acquisition does not automatically revive itself: the authority must take fresh, formal steps within the time allowed, or the land legally belongs back with its original owner.
