Delhi Development Authority v. M/s. J.B.M. Builder Pvt. Ltd.
Background
The Delhi Development Authority (DDA) filed two connected appeals (Civil Appeal Nos. 16144 and 16145 of 2017) against M/s. J.B.M. Builder Pvt. Ltd. and others. The underlying dispute raised the same legal question that the Supreme Court had already decided a few months earlier, on 4 May 2017, in a batch of appeals led by Civil Appeal No. 6112 of 2017, reported at (2017) 6 SCC 751.
Decision Breakdown
Rather than re-examine the issue, the Court simply applied its own earlier ruling in the (2017) 6 SCC 751 batch of cases directly to these facts, holding that the same outcome followed, and dismissed both of DDA's appeals on that basis. No pending applications survived the dismissal, and no order as to costs was made.
Lesson Learnt
Once the Supreme Court has settled a legal question in one case, it will apply that same ruling to later cases raising an identical issue rather than re-litigating it, so a party facing the same legal point already decided against them by a binding precedent has little chance of a different outcome on appeal.
