Delhi Development Authority v. Rainy Dhall & Ors.
Background
The Delhi Development Authority (DDA) had acquired land that was the subject of this appeal, but the landowner (Rainy Dhall) successfully argued before the lower forum that the acquisition had lapsed under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. DDA appealed to the Supreme Court against that finding.
Decision Breakdown
The Court held that the issue was already covered against DDA, in principle, by its judgment in Civil Appeal No. 8477 of 2016 (a lead/pilot case on the same point), and dismissed DDA's appeal on that basis. However, given the peculiar facts of this case, the Court gave DDA one year from the date of the order to initiate fresh acquisition proceedings by issuing a notification under Section 11 of the 2013 Act. If DDA failed to do so within that year, and if it was in possession of the land, it was directed to return physical possession to the original landowner.
Lesson Learnt
Where land acquisition proceedings "lapse" under the 2013 Act due to non-payment of compensation or non-taking of possession within the statutory period, the acquiring authority does not automatically lose all rights forever: courts may give it a fixed window to restart acquisition afresh, but if that window is missed, possession must revert to the original owner.
