Delhi Development Authority v. Ramesh and Ors.
Background
The Delhi Development Authority (DDA) appealed against a High Court order relating to land acquired from the respondents. The core legal issue was identical in principle to one already decided by the Supreme Court in a connected case (Civil Appeal No. 8477 of 2016, arising from SLP (C) No. 8467 of 2015), which had gone against DDA.
Decision Breakdown
The Court held that the issue was squarely covered against DDA by its earlier ruling in Civil Appeal No. 8477 of 2016 and dismissed the appeal on that basis. As a concession on the facts of this case, DDA was given one year from the date of judgment to issue a fresh Section 11 notification and restart acquisition proceedings under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The Court made clear that if DDA did not initiate fresh acquisition within that year, and if it was in possession of the land, it would have to hand physical possession back to the original owner.
Lesson Learnt
When a land acquisition lapses under Section 24(2) of the 2013 Act, the acquiring authority does not get an open-ended second chance: courts can impose a hard deadline to restart the process or return the land to the owner.
