Delhi Development Authority v. Ravi Dutt and Others
Background
The Delhi Development Authority (DDA) had appealed against a decision favouring the respondent landowner, Ravi Dutt, in a dispute over land that DDA had sought to acquire. The underlying legal issue was identical to one already decided by the same Court in a lead case, Civil Appeal No. 8477 of 2016 (arising out of S.L.P.(C) No. 8467 of 2015), concerning whether the original land acquisition proceedings had lapsed.
Decision Breakdown
The two-judge Bench held that the point of principle in this appeal was squarely covered against DDA by the Court's judgment in the lead case (C.A. No. 8477 of 2016) and accordingly dismissed DDA's appeal. However, taking into account the peculiar facts of the case, the Court gave DDA a one-year window to initiate fresh land acquisition proceedings by issuing a notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (using the liberty under Section 24(2) of that Act). The Court made clear that if DDA did not issue such a notification within that one year, and DDA was in possession of the land, it would have to return physical possession to the original landowner.
Lesson Learnt
When a land acquisition process lapses under Section 24(2) of the 2013 Land Acquisition Act, the acquiring authority does not automatically lose all rights: courts can grant a limited window to restart acquisition properly, but if that window is missed, possession must revert to the original owner.
