Delhi Development Authority v. Ravi Kumar Gupta and Ors.
Background
This judgment is a common/consolidated order disposing of thirteen connected civil appeals filed by the Delhi Development Authority, including Civil Appeal No. 11818 of 2016 (this case, arising from SLP(C) No. 22522 of 2015, DDA vs. Ravi Kumar Gupta & Ors.), which is explicitly named as the lead matter with the other twelve appeals listed "WITH" it and their own SLP numbers. All the appeals challenged orders holding that the underlying land acquisitions had lapsed.
Decision Breakdown
The Supreme Court held that the issue was already settled against the appellant-authority by its own earlier decisions (Civil Appeal No. 8477 of 2016 and Civil Appeal No. 5811 of 2015), and accordingly dismissed all the connected appeals, including this one. As in the companion matters, the Court gave the appellant a one-year window to initiate fresh acquisition proceedings by issuing a notification under Section 11 of the 2013 Act, failing which the appellant (if in possession) must return physical possession of the land to the original owner.
Lesson Learnt
Multiple similar land-lapse appeals by the same authority are often disposed of together in one common order once the Supreme Court has already settled the underlying legal question: citizens facing such disputes benefit from the certainty that identical issues get consistent, binding treatment.
