Delhi Development Authority v. Shamim Qureshi
Background
This is one of a cluster of near-identical DDA appeals decided the same day, where DDA challenged a finding that its land acquisition against the respondent had lapsed. The Court held the point was already settled against DDA by its judgment in the companion Civil Appeal No. 8477 of 2016.
Decision Breakdown
The Court dismissed DDA's appeal on the authority of its companion ruling, but granted DDA one year to initiate fresh acquisition proceedings under Section 24(2) of the 2013 Land Acquisition Act by issuing a Section 11 notification. If DDA failed to do so within that year and was still in possession, it was directed to return physical possession of the land to the original owner.
Lesson Learnt
A failure by the acquiring authority to complete statutory steps in time can cause an acquisition to lapse, but courts may still allow a defined grace period to restart the process rather than treating the land as permanently lost to the authority.
