Delhi Development Authority v. Ved Prakash & Ors.
Background
Another in the batch of DDA appeals on the same lapse-of-acquisition point already decided against DDA in Civil Appeal No. 8477 of 2016.
Decision Breakdown
The Court dismissed the appeal on the authority of the earlier ruling, but gave DDA one year to initiate fresh acquisition under Section 24(2) read with Section 11 of the 2013 Act, failing which it was directed to return physical possession of the land to the original owner if it held possession.
Lesson Learnt
The same legal principle on lapsed land acquisitions was applied uniformly to this landowner's case as to the many parallel DDA appeals decided the same day.
