Delhi Development Authority v. Veena Mahajan
Background
In seven connected appeals heard together, DDA's land acquisitions had resulted in compensation awards passed more than five years before 1 January 2014, the date the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 came into force. In none of these cases was there any court stay preventing DDA from taking possession, yet DDA had still not taken physical possession of the land.
Decision Breakdown
The Supreme Court held that because the awards predated the new Act by more than five years, there was no stay in operation, and possession had still not been taken, Section 24(2) of the 2013 Act squarely applied, meaning the underlying land acquisitions had to be treated as lapsed. On this basis, all seven connected appeals (including this one, Civil Appeal No. 8147 of 2016) were dismissed, with no order as to costs.
Lesson Learnt
When an acquiring authority lets five years pass after an old compensation award without taking possession, and without any court order stopping it from doing so, the 2013 Act treats the acquisition as having lapsed altogether, restoring the land to its original owner.
