Delhi Development Authority v. Vijay Dhawan HUF
Background
DDA had acquired land belonging to Vijay Dhawan HUF and others without taking possession or completing compensation within the statutory period, leading to a finding below that the acquisition had lapsed under Section 24(2) of the 2013 Act. This appeal was heard together with one connected appeal (Civil Appeal No. 8727 of 2016) on the same point.
Decision Breakdown
The Supreme Court held that both connected appeals raised an issue already decided against DDA by its lead judgment, Civil Appeal No. 8477 of 2016, and dismissed both. It gave DDA one year to initiate fresh acquisition proceedings through a new Section 11 notification, directing that the land be returned to the original owner if DDA (while in possession) failed to issue such a notification within that period.
Lesson Learnt
This case closes out the same cluster of DDA land-lapse appeals decided on 31 August 2016: a reminder that acquiring authorities face a real, enforceable deadline to complete possession and compensation once land is acquired.
