Delhi Development Authority vs. Ram Kishore Rana
Background
DDA stopped assigning duty to a Beldar (a labourer-grade worker) from 1992 onward without any charge-sheet or enquiry, later claiming his original appointment was based on a fake letter: a claim linked to a CBI investigation and FIR. The Labour Court had ordered his reinstatement with full back wages after finding no proof of fraud and that DDA's own witness admitted his 1985 joining and continued employment through 1991.
Decision Breakdown
The High Court upheld the reinstatement order, noting that CBI's own reply confirmed the worker was never charge-sheeted, that other co-accused were acquitted, and DDA never actually produced the alleged forged appointment letter as evidence. Since DDA could not prove its fraud allegation and there was solid documentary proof (ID card, provident fund receipts, increment certificates) of the worker's genuine, long employment, the reinstatement (capped at his date of retirement) was confirmed.
Lesson Learnt
An employer cannot deny a worker's rightful employment status by merely alleging fraud without producing concrete proof: bare allegations of forgery collapse against solid documentary evidence of actual, long-standing employment.
