Dharamvir & Ors. Etc. v. State of Haryana & Etc.
Background
Landowners whose land had been acquired by the State of Haryana challenged the compensation rate fixed for their land, seeking enhancement. The core issue, the correct land value per acre, had already been conclusively decided by the Supreme Court for similarly situated landowners in an earlier, connected matter ("Surinder & Ors. vs. State of Haryana & Anr.," Civil Appeal No. 5150 of 2009, decided 14.05.2015), which fixed the rate at Rs. 90,000 per acre with statutory benefits.
Decision Breakdown
Since the dispute was found to be squarely covered by the earlier Surinder decision, the Supreme Court allowed these appeals and enhanced the compensation from Rs. 81,000 to Rs. 90,000 per acre, along with all statutory benefits (such as solatium and interest) that normally accompany a land acquisition award. Noting that this was an old case, the Court directed the State to compute the enhanced amounts and deposit them before the Executing Court within four months. No costs were awarded.
Lesson Learnt
When the Supreme Court has already settled the correct compensation rate for a batch of similarly situated landowners in one case, other landowners from the same acquisition can rely on that precedent to get the same enhanced rate without re-litigating the valuation question from scratch.
