Government of NCT of Delhi (Secretary, Land and Building Department) v. Govind Ram & Anr.
Background
The Government of NCT of Delhi, through its Land and Building Department, filed this appeal (along with 36 connected appeals bearing consecutive civil appeal numbers) challenging rulings that its land acquisition proceedings had lapsed under Section 24(2) of the 2013 Land Acquisition Act, in favour of landowner Govind Ram and others similarly placed. The Court noted this was identical in substance to a batch of appeals filed by the Delhi Development Authority on the same point of law, which it had already dismissed on the same day (Civil Appeal No. 12114 of 2016).
Decision Breakdown
After condoning delay and granting leave, the Court held that since appeals raising identical issues by the Delhi Development Authority had already been dismissed, this batch of 37 appeals (the lead case and connected matters) would follow the same result. The appeals were dismissed, while preserving for the appellant the same one-year liberty granted in the DDA appeals to initiate fresh acquisition proceedings. All pending applications were disposed of with no costs.
Lesson Learnt
Where many appeals raise the same legal point already decided against a government body in a companion case, courts commonly dispose of the whole batch together by simply applying the earlier ruling, illustrating how one precedent-setting decision can resolve dozens of similar pending disputes at once.
