Govt. of NCT of Delhi through Secretary, Land and Building Department and Ors. v. Kailash Chand Gupta and Ors.
Background
The Delhi High Court had declared that land acquisition proceedings over the respondent's land had lapsed under Section 24(2) of the 2013 Land Acquisition Act, mirroring the fact pattern decided the same day by the same Bench in Govt. of NCT of Delhi v. Mahender Singh (Civil Appeal No. 9596 of 2016). The Government appealed to the Supreme Court against the declaration.
Decision Breakdown
The Court held that this case was governed by the same reasoning it had just applied in the companion Mahender Singh matter, and on that basis dismissed the appeal. It clarified that the dismissal did not bar the Government from initiating fresh acquisition proceedings for the same land under the 2013 Act, and gave it one year's liberty to do so.
Lesson Learnt
Where several land-acquisition appeals raise an identical legal point (possession not taken, compensation not paid for years), the Supreme Court can resolve a batch of them quickly by applying the reasoning of one lead decision to the rest, rather than re-analysing each individually, but the losing side (here, the government) typically still gets a fresh opportunity to redo the acquisition properly.
