Govt. of NCT of Delhi v. M/S Usha Dye Castings Pvt. Ltd.
Background
This appeal involved the same recurring land acquisition issue as several other Delhi Development Authority-linked cases (see Civil Appeal No. 9217 of 2016 in this same digest batch): the validity of old land acquisition proceedings that had not resulted in timely payment of compensation or taking of possession, now tested against the lapse provisions of the 2013 Land Acquisition Act.
Decision Breakdown
The Supreme Court held that the issue was, in principle, already covered against the appellants (the Delhi Government) by its own prior rulings in two related cases where the requisitioning authority's (Delhi Development Authority's) appeals had already been dismissed. Following that precedent, this appeal was also dismissed. The Court nonetheless gave the appellants a one-year window to exercise their statutory liberty under Section 24(2) of the 2013 Act to initiate fresh acquisition proceedings via a new Section 11 notification; if no fresh notification issued in that year, physical possession (if held by the appellants) would have to be returned to the original landowner.
Lesson Learnt
Under Section 24(2) of the 2013 Land Acquisition Act, stalled old acquisitions can lapse, but the acquiring authority may be given one final, time-bound opportunity to restart the process properly, failing which the land must go back to its original owner. This mirrors the outcome in companion cases decided by the same bench around the same date, showing the Court applying a consistent rule across a batch of similar Delhi land acquisition disputes.
