Indraj (Since Deceased) Thr. LRs. v. Union of India
Background
The appellants' land, acquired by the Union of India, was found to be similarly situated to land that had already been the subject of an earlier Supreme Court order dated 17.12.2014 in Civil Appeal No. 9910 of 2011 and other connected matters (which had settled the compensation principles for that acquisition). Delay in approaching the courts was also condoned on the condition that no interest would be payable for the delay period.
Decision Breakdown
Since the appellants' land was undisputedly similarly situated to the land already dealt with in the earlier 2014 order, the Supreme Court disposed of these appeals in terms of that earlier order, making it part of the present judgment, with no order as to costs. Leave was granted and the delay condoned subject to the no-interest condition.
Lesson Learnt
When multiple landowners are affected by the same acquisition and one group's compensation dispute is already settled by the courts, similarly situated owners can have their own cases resolved on the same terms without needing to re-litigate the same questions from scratch.
