Jagdish Mavji Tank (Dead) Through Lrs. & Ors. vs Harresh Navnitrai Mehta & Ors.
Background
The case concerns the decades-long redevelopment dispute over the "Jariwala Chawls" property in Mahim, Mumbai, where tenants had been waiting over 25 years for new flats. The Supreme Court had earlier (in 2016 and 2017) directed the developer, M/s Raj Doshi Exports Pvt. Ltd., to redevelop the property within 42 months and directed the housing authority MHADA to issue the necessary No Objection Certificate without certain disputed conditions. When the 42-month deadline passed with construction still not started, the tenants filed this contempt petition, while MHADA and the developer filed cross-applications disputing ownership of a portion of the land and the terms of redevelopment.
Decision Breakdown
The Court found the builder guilty of gross negligence for failing to comply with its own undertaking to complete redevelopment, and found MHADA equally responsible for creating obstacles by insisting on unreasonable conditions (such as sub-division of the plot) and wrongly claiming ownership over a portion of land already directed to be handed over to the developer. Rather than punishing the builder for contempt, the Court accepted a fresh, detailed undertaking filed by the builder specifying a concrete timeline and compensation terms for the tenants, warned both the builder and MHADA that any further non-compliance would be viewed seriously, and closed the contempt petition with liberty for the tenants to return to court if the new undertaking was also violated.
Lesson Learnt
Even a formal finding of contempt is sometimes withheld in favour of a concrete, court-monitored compliance plan when doing so better serves the people actually affected (here, tenants waiting decades for housing), but such leniency comes with an explicit warning that the next default will be treated seriously. Note: the listing/admission bench included the then Chief Justice, but the judgment was actually signed by Justice L. Nageswara Rao and Justice B.R. Gavai.
