Kalawati Wamanrao Gaikwad (Died) Thr LRs Etc. v. Regional Officer M.I.D.C. Latur and Ors.
Background
Landowners whose land had been acquired by the Maharashtra Industrial Development Corporation (MIDC) at Latur had been awarded enhanced compensation by a Reference Court, but the High Court's order restricted how that enhanced amount could be released to them. The landowners (and connected appellants in tagged matters) appealed to the Supreme Court against the High Court's order governing release of the enhanced compensation.
Decision Breakdown
The Supreme Court condoned the delay in filing and granted leave to appeal. Following its own earlier order dated 11.09.2015 in a related matter (Civil Appeal Nos. 7070-7071 of 2015) involving the same type of dispute, the Court directed that 50% of the enhanced compensation be released to the appellants without requiring any security, while the remaining 50% would be released only on the appellants furnishing security to the satisfaction of the Reference Court. The High Court's order was set aside and all the connected appeals were allowed on these terms.
Lesson Learnt
Courts can and do apply a prior, closely similar ruling as a template to quickly and finally resolve a batch of related compensation-release disputes, so landowners awaiting enhanced compensation may get partial, unconditional release of funds while the balance is secured pending final confirmation.
