Legal Representative of Bhagwani Devi, Bharat Bhusan vs. The State of Rajasthan and Others
Background
Government land originally allotted to one Lal Chand was agreed to be sold to Bela Ram in 1986, and an application was made under the Rajasthan Colonization Act to regularize the sale by paying a compounding fee. After the original agreement was cancelled and later revived by Bela Ram's son, and after the property was in the meantime purchased by the appellant's predecessor, the Additional District Collector rejected the compounding application and this rejection was upheld through two levels of appeal. The appellant then filed a writ petition, which a Single Judge of the Rajasthan High Court allowed, but a Division Bench reversed on further appeal by the State, holding that transfer restrictions under a 1991 notification still applied.
Decision Breakdown
The Supreme Court examined the actual text of three government notifications: a 1971 notification that had imposed transfer restrictions on land in the Vijaynagar colonization area, a 1985 notification that expressly repealed the 1971 restriction, and a 1991 notification. The Court found that the 1991 notification did not revive the restriction for this area, it actually excluded the Act's operation for land inside the Indira Gandhi Canal and Ganganahar project areas, so the Division Bench's reliance on it was "totally without substance." Since the restriction had been lifted by the 1985 repeal and never validly reimposed on this land, there was no legal basis to block the transfer, and the Division Bench had wrongly reversed the Single Judge. The Supreme Court allowed the appeal, quashed the Division Bench's order, and restored the Single Judge's judgment in the appellant's favour.
Lesson Learnt
When multiple government notifications affect the same land over time, courts must carefully trace the actual sequence: a later notification does not automatically revive an earlier restriction unless its own text says so; reading it out of context can wrongly deprive a bona fide purchaser of land rights.
