Molugu Mahipal Reddy & Ors. v. M. Pradeep Kumar & Ors.
Background
This order sends the case back; it does not decide the dispute. In PIL No. 130 of 2014 about allegedly illegal registration of land in Sy. No. 215 of Kapra Village, Keesar Mandal, Rangareddy District, the High Court at Hyderabad directed the District Collector and other officials to implement earlier orders within eight weeks. The appellants, third-party purchasers and claimants over the land, had not been made parties or heard.
Decision Breakdown
This is not a final decision on the dispute. The Court held that the High Court's orders of 22 May 2014 and 11 August 2014, and the order in Review W.P.M.P. No. 257 of 2014, were unsustainable because the appellants had no opportunity to be heard. It set those orders aside and sent the PIL back to the High Court for fresh disposal after impleading and hearing the appellants. It said it had expressed no final opinion on the contentions, and directed the parties to appear before the High Court on 16 November 2015.
Lesson Learnt
There is no final ruling yet on whose rights prevail over the land. Orders affecting people who were not heard cannot stand.
