M/s Kaushik Coop. Building Society v. N. Parvathamma & Ors.
Background
A housing society had purchased and developed land whose title and survey-number identity had already been settled in its favour through multiple earlier court proceedings spanning decades, including a 1976 specific-performance decree and several dismissed "land grabbing" cases. Despite this, a fresh Land Grabbing Case (No. 44/2000) was filed by a different claimant disputing the same land's identity, and the Andhra Pradesh High Court refused to quash it, holding that the question of res judicata could only be decided after a full trial. The society and an associated purchaser appealed to the Supreme Court to have the fresh case thrown out at the threshold.
Decision Breakdown
The Supreme Court held that the identity and ownership of the land had already been conclusively and repeatedly determined in prior litigation between effectively the same parties and interests, so the doctrine of res judicata squarely applied and barred the fresh Land Grabbing Case from proceeding. The Court surveyed a long line of precedent on res judicata, holding that the principle exists to secure finality in litigation and prevent a party from being vexed twice over the same matter, and that it applies to land grabbing proceedings and writ proceedings and not merely ordinary civil suits. Finding that the High Court and the Special Court erred in not appreciating that the matter in issue was identical to matters already finally decided, the Court quashed the proceedings in the fresh Land Grabbing Case and the order refusing to reject it, allowed the society's appeals, dismissed the connected appeals by the other side, and also dismissed a related contempt petition.
Lesson Learnt
Once a property dispute between effectively the same parties over the same land has been conclusively decided by courts, the losing or disputing side cannot keep relitigating the same issue through fresh proceedings under a different law: the principle of finality (res judicata) protects a settled title from endless fresh challenges.
