National Aluminium Co. Ltd. v. Ananta Kishore Rout
Background
NALCO established and financially supported two township schools for employees' children, while independent school managing committees employed their staff. Teachers and other staff claimed that NALCO's funding, facilities and representation on the committees made them NALCO employees entitled to its pay and benefits. The High Court accepted that claim.
Decision Breakdown
The Court allowed NALCO's appeals and set aside that decision. The registered managing committees controlled appointments, discipline, promotions and other service matters, so corporate funding and limited oversight did not establish an employer-employee relationship with NALCO. The staff also could not claim equal pay with NALCO's industrial employees because their work, qualifications and recruitment were different. However, the Court made NALCO's assurance binding that school staff would not lose their jobs merely because the school-management agency changed.
Lesson Learnt
An institution's financial sponsor is not automatically the employer of everyone working there. Employment control and comparable duties matter, while a specific assurance accepted by the Court can separately protect staff when management changes.
