N.I.I.T. Ltd. vs. Regional Provident Fund Commissioner
Background
NIIT had partnered with the Karnataka government to provide computer education in around 700 schools, working through 23 licensee companies, one of which (Myzas Technologies) later admitted liability for unpaid provident fund contributions of its own staff. Karnataka's PF authorities formally discharged NIIT from the enquiry after Myzas accepted responsibility, yet Delhi's Regional PF Commissioner still issued a fresh notice demanding NIIT produce records and answer for the same dues, on the basis that NIIT's PF matters were handled from its Delhi office.
Decision Breakdown
The Court found that Karnataka's PF authorities and courts had already comprehensively examined this exact dispute, over the same project, same employees, and same liability, and had specifically discharged NIIT after fixing responsibility on Myzas, and that this discharge order had never been challenged or set aside. It held that the Delhi office's location could not justify reopening an issue already conclusively decided by the competent authority with actual jurisdiction over the project and employees in Karnataka, and quashed the Delhi notice as an impermissible parallel proceeding.
Lesson Learnt
Once a regulatory authority with proper jurisdiction over a matter has examined and resolved an issue, another branch of the same authority (even in a different state) generally cannot reopen the identical dispute against the same party over an office-location technicality.
