P. Pramila Rani v. Narasamma & Ors.
Background
This order sends the case back; it does not decide the dispute. The property and succession dispute turned on whether the appellant was the daughter of a deceased person. By an earlier order of 21 September 2015, the Court had directed the trial court to record additional evidence on that point.
Decision Breakdown
This is not a final decision on the dispute. The Court recorded that the appellant had produced sufficient evidence on that specific point. It set aside the two High Court judgments under challenge, the First Appeal decision and the Review Petition order. It sent the entire matter back to the High Court to decide the appeal afresh after considering that evidence, and directed the parties to appear before the High Court on 8 March 2016.
Lesson Learnt
There is no final ruling yet on the succession and property dispute. The High Court will decide the appeal afresh in light of the additional evidence.
