Paradeep Phosphate Ltd. v. Paradeep Phosphate Mazdoor Union
Background
Contract workers cleaning parts of Paradeep Phosphate's DAP plant had continued through successive contractors for about fifteen years. Their union sought implementation of an Odisha notification abolishing contract labour for that work. The company challenged the High Court's implementation and regularisation directions, arguing that the State was not the appropriate government.
Decision Breakdown
The Court dismissed the company's appeals and left the High Court's directions to implement the notification and regularise the specified cleaning workers in force. Earlier litigation between these parties concerning the abolition recommendation had become final, and the company could not reopen its appropriate-government objection in this proceeding. The Court expressly left the general question of which government was competent open for a suitable case. Its ruling therefore rested on this litigation history and the operative notification, rather than establishing automatic absorption whenever contract labour is abolished.
Lesson Learnt
An employer must comply with an operative abolition notification and cannot repeatedly reopen issues barred by final earlier litigation. This case does not promise automatic regularisation to every contract worker.
