Pradeep Kumar Etc. Etc. v. State of U.P. and Anr.
Background
This order sends the case back; it does not decide the dispute. The landowners challenged the compensation fixed for their acquired land. They had been awarded Rs. 135 per square yard, while Rs. 297 per square yard had been awarded for similarly situated land acquired in 1986.
Decision Breakdown
This is not a final decision on the dispute. The Court found that certain aspects of the valuation and location of the land had not been properly discussed by the High Court, and noted the unexplained disparity in rates. It set aside the High Court's judgment and sent the matters back to the High Court for reconsideration, with the parties to appear there on 28 March 2016. It directed that the compensation already awarded be paid to the landowners within three months in the meantime.
Lesson Learnt
There is no final ruling yet on the correct compensation payable to the landowners. The High Court will determine it again.
