Raghubir Singh v. General Manager, Haryana Roadways, Hissar
Background
A Haryana Roadways conductor was dismissed while facing a criminal case concerning ticket collections and was treated as absent from duty. He said the employer had promised reinstatement upon acquittal, but refused to take him back after that acquittal. After initially receiving a favourable Labour Court award, he lost on remand because the tribunal treated his industrial dispute as time-barred.
Decision Breakdown
The Supreme Court allowed his appeal and ordered reinstatement with continuity, wage revisions and other consequential benefits within six weeks. It found no adequate justification for dispensing with an inquiry, and considered dismissal disproportionate in the circumstances. The Labour Court had wrongly avoided the merits of the dispute on limitation grounds despite the explanation for waiting until acquittal. To account for delay, the Court confined back wages to the period from March 2, 2005, when the industrial dispute was raised, until reinstatement.
Lesson Learnt
An employer must justify dismissing a worker without the required inquiry. Delay in challenging dismissal must be considered in context and can affect back wages without automatically defeating a genuine industrial dispute.
