Rajbir and Ors. v. State of Haryana and Ors.
Background
This order sends the case back; it does not decide the dispute. Land owners in Haryana disputed the compensation fixed for land acquired for the Kundli-Manesar-Palwal Expressway Project. They challenged the way the High Court had valued the land.
Decision Breakdown
This is not a final decision on the dispute. The Court found that the High Court had erred in its valuation method: it wrongly relied on the notification of a later, unrelated acquisition, wrongly applied a belting system, and wrongly introduced cuts for a linear expressway acquisition. The Court set aside the High Court's judgment and sent the matter back for the land value to be determined afresh. It requested the High Court to dispose of the matter within six months.
Lesson Learnt
There is no final ruling yet on the compensation payable. Valuation methods such as belting or cuts tied to road frontage do not fit land taken for a linear project like an expressway, and a later, separate acquisition should not be used to discount the value.
