Ramrao Shankar Tapase vs Maharashtra Industrial Development Corporation
Background
In 1995 the Maharashtra government acquired several plots of agricultural land in village Bhoyar, Yavatmal district, to extend an industrial estate for the Maharashtra Industrial Development Corporation (MIDC). The Land Acquisition Officer fixed compensation at fairly low per-hectare rates; the affected landowners, including the appellant Ramrao Tapase (whose 4.91 hectares in Survey No. 31/2 had been valued by the original award), got that amount enhanced by a Reference Court, but the Bombay High Court, on MIDC's appeal, partly reduced those enhanced amounts. Ramrao Tapase and several other landowners from the same acquisition then jointly approached the Supreme Court, since their claims all turned on the same set of facts about land value in that village.
Decision Breakdown
The Supreme Court found that the High Court had correctly relied on a 1992 sale deed (Exhibit 41) for a nearby plot to fix the base market value, but had understated the annual cumulative escalation that should be applied to bring that value up to the 1995 acquisition date. The Court held a 12% cumulative annual increase should have been used instead of 10%. Applying the corrected escalation and the usual addition for non-agricultural potential, the Court raised the per-hectare compensation across the whole group of appeals; for Ramrao Tapase specifically, compensation was increased from Rs. 1,50,000 to Rs. 1,75,000 per hectare, with statutory benefits under the Act. Two of the connected claimants who had filed with over 400 and 600 days' delay were denied interest for the delayed period, but everyone's principal compensation was revised upward.
Lesson Learnt
In land acquisition cases, courts fix compensation not just from a comparable sale deed's price but by carefully applying a cumulative annual escalation rate to bring that value up to the acquisition date, even a 2% difference in that escalation rate can meaningfully change what landowners are ultimately paid.
