Rattan Lal v. State of Punjab & Anr.
Background
The appellant's land had been acquired by the State of Punjab, and he challenged the adequacy of the compensation awarded by the High Court. A similarly situated group of landowners, in Paramjit Panag & Ors. v. State of Punjab, had earlier obtained an enhancement of Rs. 1,00,000 per acre from the Supreme Court by an order dated 15.01.2015.
Decision Breakdown
Condoning the delay and granting leave, the Supreme Court applied the principle of parity with the Paramjit Panag order and disposed of the appeals by declaring that the appellants were entitled to an additional Rs. 1,00,000 per acre over and above what the High Court had granted. The appellants were also held entitled to all other statutory benefits, except for the period covered by the delay (including delay in refiling).
Lesson Learnt
Landowners whose compensation disputes raise the same issue already decided in favour of similarly situated persons can rely on the principle of parity to secure the same enhancement without re-litigating the underlying valuation question.
