Rishiroop Rubber (International) Ltd. v. State of Gujarat
Background
This appeal arose from a Gujarat High Court order (in a Letters Patent Appeal) that had affirmed a Single Judge's dismissal of the appellant company's challenge in a labour reference matter. While the appeal was pending before the Supreme Court, the Court had earlier (on 1 December 2014) directed the Industrial Tribunal at Vadodara to pass a fresh order in the underlying reference, and the Tribunal did so on 23 March 2015.
Decision Breakdown
The Supreme Court held that because the Industrial Tribunal had since passed a fresh order pursuant to its earlier direction, the present appeal no longer had any live controversy to decide and "does not survive." Rather than leaving the earlier adverse High Court order standing, the Court set aside the impugned High Court judgment (which had affirmed the Single Judge's order), while clarifying that the respondent (State of Gujarat) remained free to separately challenge the validity of the Tribunal's new order if it wished. The appeal was accordingly disposed of as allowed to this limited extent, with no order as to costs.
Lesson Learnt
When the underlying dispute that gave rise to an appeal has already been resolved by a subsequent order from the original forum, courts will clear away the now-redundant earlier order rather than let it remain on record, while leaving the door open for a fresh challenge to the new order if a party is still aggrieved.
