Sachichidanand Prasad & Ors. v. General Manager, National Thermal Power Corp. & Anr.
Background
Land belonging to the appellants was acquired for the National Thermal Power Corporation, and the Collector fixed compensation at Rs. 357 per decimal. On reference, the Reference Court raised this to Rs. 1,988 per decimal, but the High Court, on appeal, held this fixation erroneous and set aside the Reference Court's award. The appellants then approached the Supreme Court.
Decision Breakdown
During the hearing, the respondents produced an additional counter-affidavit showing that similarly situated landowners whose land was acquired for the same project had since settled their claims at Rs. 480 per decimal, with the appellants' counsel pointing to even higher settlements for others. The Court disposed of the appeals by directing that the appellants' land value be fixed at Rs. 480 per decimal with all statutory benefits, and further directed that if the appellants could show within one month that other similarly situated persons in the vicinity had been granted higher rates, those higher rates would apply to them as well. Payment was directed to be completed within three months, with no order as to costs.
Lesson Learnt
In land acquisition disputes, courts will look at what similarly situated landowners in the same acquisition actually received and extend parity in compensation, rather than leaving unequal payouts for comparable land to stand.
