Sree Balaji Nagar Residential Association v. State of Tamil Nadu
Background
Residents challenged acquisition for a Chennai surplus-water canal, raising displacement and environmental concerns. An award was made in November 2006, but courts protected them from dispossession while litigation continued. When the 2013 land-acquisition legislation commenced, they argued the older proceedings had lapsed.
Decision Breakdown
The Supreme Court accepted lapse of the acquisition proceedings under its interpretation of Section 24(2) in this 2014 decision. More than five years had passed since the award and the State had not taken physical possession. It held that the statutory wording then considered did not exclude periods covered by court stays from the five-year calculation. The State remained free to begin fresh acquisition under the 2013 Act; the Court did not finally decide the engineering objections to the canal.
Lesson Learnt
The residents retained their land under the lapse rule applied in this historical decision. A declaration that an old acquisition has lapsed does not prevent the government starting a new lawful acquisition.
