State of Madhya Pradesh v. Anees Khan
Background
Anees Khan worked briefly as a Public Works Department roller driver's assistant before being disengaged in 1992. An ex parte labour court order directed reinstatement and back wages until February 1994, which were paid. He later claimed further wages through March 2001 although he had neither reported for duty nor pursued enforcement of reinstatement.
Decision Breakdown
The Court held that Khan was not entitled to the additional back wages upheld below. The earlier order had become final and its awarded wages had been paid, but his subsequent conduct showed no effort to resume work or enforce reinstatement. He could not claim continuing wages solely by relying on that order after abandoning the reinstatement claim. Taking an overall view of the particular circumstances, however, the Court directed Madhya Pradesh to pay him Rs. 1,00,000 within three months of receiving the judgment and disposed of the appeal on that basis.
Lesson Learnt
After obtaining reinstatement, a worker should act to join duty or enforce the order. A final reinstatement decision does not automatically produce wages indefinitely when the worker makes neither effort.
