State of Uttar Pradesh through Secretary, Irrigation and another v. Km. Shashi Joshi
Background
A daily-wage typist worked intermittently for the Uttar Pradesh Irrigation Department before her engagement ended in January 1990. The Labour Court ordered reinstatement with back wages, and the High Court upheld the award. In the Supreme Court she agreed to forgo back wages if reinstated, and the Department accepted that course.
Decision Breakdown
The Court partly allowed the appeal by removing the back-wages direction while retaining reinstatement as a daily wager. It noted that the award did not find that she had remained without other employment after the engagement ended. Both sides had expressly accepted reinstatement without back wages as the limited resolution of the appeal. The Department had to reinstate her within one month. If it failed to do so, it had to pay daily-wage earnings from the expiry of that month, giving effect to the continuing reinstatement obligation.
Lesson Learnt
The reinstatement ordered here preserved daily-wage status and followed an agreement to waive back wages. An employer could not delay compliance indefinitely: wages became payable after the Court's one-month deadline if reinstatement did not occur.
