Sushil Kumar Jindal v. Aasia Begum
Background
This was a tenant's appeal against a High Court order which had upheld the Rent Controller's finding that the landlord (respondent) had a bona fide requirement for the tenanted premises, entitling her to recover possession.
Decision Breakdown
The Supreme Court found no reason to interfere with the concurrent findings of the Rent Controller and the High Court on bona fide requirement, and accordingly dismissed the tenant's appeal. However, taking a practical, equitable view of the facts, the Court granted the tenant time until 31 December 2017 to hand over vacant possession (subject to filing an undertaking within four weeks), and directed that he continue paying use-and-occupation charges of Rs. 2,450 per month in the meantime.
Lesson Learnt
Even when a tenant's appeal on the merits of "bona fide requirement" fails, the Supreme Court can still soften the practical impact by granting a reasonable transition period to vacate, balanced against continued payment of occupation charges to the landlord.
