The General Manager - Operations Chennai Container Terminal Pvt Ltd & Anr. v. K. Thiruthanikumaran & Anr.
Background
A workman's employment with a container-terminal company had been terminated, leading to a strained relationship and multiple pending proceedings: a civil suit before the Chennai City Civil Court and conciliation proceedings under the Industrial Disputes Act. The matter reached the Supreme Court by way of appeal against a Madras High Court order, and the Court invited a senior counsel to mediate between the parties rather than deciding the underlying dispute on merits.
Decision Breakdown
With the help of the court-appointed mediator, and noting the workman's age (around 45, still employable) and the breakdown of the relationship, the Court recorded a negotiated full and final settlement: the employer was directed to pay the workman Rs. 25,00,000 (inclusive of gratuity and provident fund) plus Rs. 50,000 towards litigation costs, totalling Rs. 25,50,000, within 10 days. All pending proceedings, the civil suit and the industrial dispute proceedings, were directed to be terminated/struck off, and both parties were barred from further litigation over the employment relationship without the Court's leave.
Lesson Learnt
The Supreme Court can and does encourage mediated, lump-sum settlements in long-running employer-employee disputes instead of deciding every legal issue on merits, closing out all parallel proceedings (civil suit, labour conciliation, etc.) in one stroke once a settlement is reached.
