The Managing Director, Chennai Metro Rail Ltd. v. N. Ismail and Others
Background
Government land had been granted for a charitable rest house serving railway travellers, with a reserved right to resume it. The court-appointed trustee later leased part of the land for a hotel to raise money for the trust. The hotel lessee challenged its resumption for the Chennai Metro project.
Decision Breakdown
The Court upheld the government's right to resume the land for the public project under the original grant. It rejected the suggestion that the trustee's court-authorised leasing had itself violated the charitable purpose: the hotel occupied the property lawfully. That lawful occupation nevertheless remained subject to the government's retained rights. The government had to compensate the hotel buildings according to the grant's valuation terms within three months, and the land was to be surrendered through the trustee within four weeks.
Lesson Learnt
A lease obtained from a charitable trustee can remain subject to conditions in the original government grant. Lawful occupation may carry a right to building compensation even when it cannot prevent resumption.
