Transport and Dock Workers Union v. M/S. Shree Sadguru Krupa Freight Services
Background
A trade union had raised an industrial dispute/complaint on behalf of workers against their employer, a freight services company. By the time the matter reached the Supreme Court, all the concerned workers had already been terminated from service with effect from 01.04.2015, which both sides agreed made the legal questions originally raised in the appeal purely academic.
Decision Breakdown
Since the underlying employment relationship had ended and the dispute had become academic, the Supreme Court did not rule on the legal questions raised and instead left them open for a future case with live facts. Counsel for the workers confirmed, on instructions, that the terminated workers would not challenge their termination under any law. On that basis, the Court treated the underlying complaint and reference as withdrawn and dismissed as such, and finally disposed of the appeal itself with no order as to costs.
Lesson Learnt
When the real-world dispute underlying a case evaporates (here, because the workers in question were no longer employed and chose not to contest their termination), courts will close the case on that practical basis rather than deciding abstract legal questions that no longer affect the parties before them: a reminder that courts generally decide live disputes, not hypothetical ones.
