Velayudhan v. Mohammedkutty
Background
This order sends the case back; it does not decide the dispute. The case is a property dispute in which a suit for permanent injunction was filed and the question of title was also in issue. In the second appeals, the Kerala High Court treated the suit as one for permanent injunction simpliciter and framed its substantial question of law on that footing.
Decision Breakdown
This is not a final decision on the dispute. The Court held that the High Court had framed the wrong substantial question of law, because the question of title was also relevant in the suit. Relying on Anathula Sudhakar vs. P. Buchi Reddy (2008) 4 SCC 594, it set aside the High Court's order. It sent the second appeals back to the High Court for the question to be reframed and the appeals decided afresh on merits.
Lesson Learnt
There is no final ruling yet on title, possession or the injunction. A court must check whether a suit that asks only for an injunction also raises a live question of title, because that changes the legal questions to be decided.
