Vinay Eknath Lad v. Chiu Mao Chen
Background
This order sends the case back; it does not decide it. In an eviction suit over a shop in Bengaluru, the tenant challenged the plaintiffs' right to sue as co-owners succeeding a dissolved partnership firm. The High Court reversed the trial court.
Decision Breakdown
This is not a final decision on the eviction. The Court found that the High Court had not examined a 2004 notice that could show the original plaintiffs' ownership and the tenant's attornment. It declined to admit new documents, set aside the judgment and sent the question of the plaintiffs' title and right to sue back to the High Court.
Lesson Learnt
There is no final ruling yet. The High Court must decide who is entitled to sue for possession.
